Water
New Mexico follows prior appropriation through the Office of the State Engineer. A permit is required for a domestic well. Single-household wells are generally limited to about one acre-foot a year, including outdoor irrigation, with tighter limits in some areas, and newer wells must be metered. These limits should be confirmed with the State Engineer for each parcel.
About a fifth of the state has completed water-rights adjudication and more than half is in adjudication, so the title to a water right deserves the same scrutiny as the title to the land. The State Engineer's policy on rainwater harvesting should also be confirmed before large systems are designed.
Building codes
New Mexico adopts minimum building codes statewide through its Construction Industries Division, with a statewide permitting rule in effect since 2022. Homeowners can obtain permits to build their own primary residence, though electrical, plumbing and mechanical work requires qualification. We confirm the current code edition with the state for each project.
Climate and growing season
New Mexico spans zones 5a to 8b. Albuquerque has a frost-free season of about 199 days, and New Mexico State University puts warmer zones well beyond 200. The long season makes outdoor food production a larger share of the plan than in the northern states.
Hazards
New Mexico's hazard plan rates wildfire, flood, thunderstorm and drought as high hazards, with extreme heat, high wind and winter storms as moderate. Wildfire and drought account for most of the state's billion-dollar disaster costs in NOAA's records.
Our view
New Mexico pairs long seasons with low density, but water diligence is the whole game: the right well, a clearly adjudicated right, and a design that stores and conserves every gallon.
This guide is general information, current to October 2026, and not legal, tax or water-rights advice. Water and building rules change and vary by county and basin. We verify every requirement for a specific parcel with the responsible agency before purchase.
